Terms of Use

These Terms govern access to blackkeelgames.com and Black Keel Games development builds or playtests made available under these Terms, including Fortune & Gallows. By accessing or using those services, you agree to these Terms.
1. Development and Playtest Status
Playtest builds are unfinished software provided for evaluation and testing. Features, content, rules, accounts, characters, saves, balance, availability, pricing plans, and technical systems may change without notice. Test data may be reset, migrated, corrupted, or deleted. Access may be suspended or ended at any time.
2. Limited Permission to Use
Black Keel Games grants you a personal, limited, revocable, non-exclusive, non-transferable permission to access the website and any authorized playtest for personal testing and entertainment, subject to these Terms and any additional playtest notice or end-user license presented with a build.
3. Ownership
The Black Keel Games name and branding and the protectable content, software, writing, designs, artwork, game systems, documentation, and other materials made available by Black Keel Games are owned by Black Keel Games or used under license, except where otherwise stated. These Terms do not transfer ownership of intellectual property to you.
4. Acceptable Use
You may not attempt unauthorized access to accounts, databases, administrative systems, source code, credentials, or infrastructure; interfere with service operation; distribute malware; abuse or overload the service; impersonate another person; exploit bugs to damage the service or other users; or use the service unlawfully.
5. Feedback
If you voluntarily submit ideas, bug reports, suggestions, playtest comments, or other feedback, you give Black Keel Games permission to use, reproduce, modify, develop, and incorporate that feedback into its games, services, documentation, or business without compensation or obligation to you. This does not transfer ownership of unrelated pre-existing intellectual property you clearly identify as your own.
6. Accounts and Security
If an account is provided, you are responsible for maintaining your credentials and activity under your account. Do not share authentication links or passwords in a manner that permits unauthorized access.
7. AI-Generated and Dynamic Content
Some game content may be dynamically generated or assisted by artificial intelligence. It may occasionally be inaccurate, inconsistent, unexpected, or historically imperfect, especially during development. Dynamic output is entertainment content and should not be relied upon as professional advice.
8. Third-Party Services
Our services may depend on third-party hosting, database, authentication, AI, distribution, payment, communication, or other technology providers. Your use of certain third-party services may also be subject to their terms.
9. No Warranty for Development Builds
To the maximum extent permitted by law, development and playtest services are provided “as is” and “as available,” without warranties of uninterrupted availability, error-free operation, preservation of saves, fitness for a particular purpose, or compatibility with every device or browser.
10. Limitation of Liability
To the maximum extent permitted by law, Black Keel Games will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use a development build or website, including loss of test saves, game progress, data, or access. Nothing here excludes liability that cannot lawfully be excluded.
11. Suspension or Termination
We may restrict or terminate access to a playtest or service when reasonably necessary for development, maintenance, security, abuse prevention, legal compliance, or enforcement of these Terms.
12. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.
13. Changes
We may update these Terms as development continues. Continued use after updated Terms are published constitutes acceptance of the revised Terms to the extent permitted by law.
